PRIVACY INFORMATION

  • It is in APCOA’s legitimate interests to accept bookings for use of the Car Park as well as to regulate parking by those using the car park in accordance with such a booking. Also, you enter into a contract every time you book to use the car park as well as every time you make use of it. This includes your agreement to your information being processed as part of the contracts you make to use the car park.
  • On entry to and while you are using the car park APCOA collects and processes certain data to make sure that the booking made by you and the conditions that apply to your booking (which include the terms set out above and those displayed at the car park are complied with and to enforce these where necessary. This may include obtaining the registered keeper’s name and address from the DVLA in order to send a Notice to Keeper, any related correspondence and any further notices if a Parking Charge becomes payable and/or remains unpaid.
  • APCOA will also use the data it collects for car park management such as reporting on vehicle turnover and repeat visits in order to improve the customer experience. The data we collect may include images of vehicles using the car park and/or their vehicle registration mark. This can be collected via ANPR cameras and/or attendants on site as well as via payment machines or terminals.
  • APCOA may share data from time to time as required to support the purposes stated above and may pass data to the police if we have reason to think that a crime may have taken place. If relevant and appropriate, APCOA may also, from time to time, share the data it has collected with a client who has appointed it to manage the Car Park.

1. Introduction

These are the Terms and Conditions upon which we accept Bookings on line or by telephone to park at our Hotel Car Parks. It is important that you read them and understand them before completing your Booking.

 

Our Conditions of Parking also apply and form part of the same contract that is created by a Booking. These are set out below. Again, please read them and understand them before completing your Booking.

 

When reading these Booking and Payment Terms, the following words or phrases have the following meanings:

Booking Period means the period commencing with the date that you specify as your date of entry to the Car Park, and ending on the date that you specify for leaving it.

 

Car Parks means the car parks controlled by us and Car Park shall be interpreted accordingly.

 

Conditions of Parking means the conditions of parking published on our website and displayed at the entrance to our Car Parks.

 

Tariff Board means any board or notice at a Car Park displaying the charges to be paid for parking.

 

Booking means any booking for the parking of a Vehicle at a Car Park.

 

Booking and Payment Terms means these Booking and Payment Terms.

 

Permissible Amendments means only amendments to:
- time of entry but only on the Booking commencement date
- Vehicle registration details;
- driver details.

 

Vehicle means any Vehicle which is parked in a Car Park and includes any mechanical device on wheels or tracks, its equipment and accessories.

 

We, us, our means Apcoa Parking (UK) Limited.

 

You, your means any person who makes a Booking or (where the context allows) uses a Car Park for the parking of a Vehicle.

 

 

The headings are for information only and do not affect the interpretation of these Booking and Payment Terms.

 

These Booking and Payment Terms and any Booking resulting from them are subject to English law.

 

2. The Agreement between you and us

 

2.1 These Booking and Payment Terms apply to your Booking. So do the Conditions of Parking.

 

2.2 We follow & stand by both the Booking and Payment Terms and the Conditions of Parking. If there is anything you do not understand or do not agree with, please discuss this with us before making your Booking

 

2.3 Our employees or authorised agents are not permitted to make any representations unless these are confirmed in writing. If we agree changes, please ask us to confirm them in writing.

 

2.4 Nothing in these Booking and Payment Terms or the Conditions of Parking affects your statutory rights.

 

2.5 If you book online at https://travelodgeparking.apcoa.co.uk, a binding agreement will exist between you and us after you have transmitted a completed booking form to us via the online booking system, and we have sent an e-mail acknowledgement to you in accordance with condition 3 below

 

2.6 If you book over the telephone, a binding agreement will exist between you and us when our telephone sales person gives you your Booking reference, in accordance with condition 4 below.

 

 

3. How to Book Online

 

3.1 If you wish to park your Vehicle in our Car Park and wish to book online, please complete the booking process at https://travelodgeparking.apcoa.co.uk in which you will submit your Booking request to us.

 

3.2 Once we have received your completed booking form through the process outlined in condition 3.1, we will send an e-mail to you at the e-mail address you have provided on the booking form. That e-mail will include a Booking reference which you need to quote if you would like to contact us about your Booking.

 

3.3 The Booking will be completed when we send that e-mail. In the event that you cannot provide an e-mail address for this purpose, we will post the confirmation to you at the postal address you provide on the booking form. The Booking is completed when we post that confirmation to you.

 

3.4 Please check immediately that the information contained in the Booking confirmation email or letter is correct and let us know if it is not. Our contact details are set out below in condition 13.

 

3.5 The Booking is personal to the person making it and cannot be transferred to any other person.

 

 

 

4. How to Book over the Telephone

 

4.1 If you wish to park your Vehicle in one of our Car Parks and would like to book by telephone, please call us on 0344 332 1236 . (Calls from UK BT land lines will cost no more than 10 pence per minute. Calls from mobiles and other networks may vary and may be higher).

 

4.2 Our telesales staff will complete your booking form by taking the relevant details from you. On completion of the Booking, you will be given a Booking reference which you will need to quote if you would like to contact us about your Booking.

 

4.3 The Booking will be completed when we provide you with your Booking reference. If you provide us with an e-mail address, we will e-mail a confirmation of your Booking to you. In all other cases, we will post the confirmation to you at the postal address you provide the telesales staff with when completing the booking form on your behalf.

 

4.4 Please check immediately that the information contained in the Booking confirmation e-mail or letter is correct and let us know immediately if it is not. Our contact details are set out below in condition 13.

 

4.5 The Booking is personal to the person making it and cannot be transferred to any other person.

 

5. Change to the Booking Period

 

No refund will be made if your stay is shorter than the Booking Period. If you arrive early or leave late, meaning your Vehicle is parked in a Car Park on days or time outside the Booking Period, you will be charged for those extra days/time at the rate specified on the Tariff Board applicable to the Car Park. This will be the case even if your total stay is no longer than the Booking Period. Please note that the rate that you are charged for this extra stay will be the rate that would have been charged had you not pre-booked.

 

6. Booking Disabled Spaces

 

Our Car Parks have disabled spaces for use by blue badge holders, but unfortunately we cannot accept bookings specifically for disabled spaces. If you have any particular requirements, please contact a member of Travelodge staff on arrival. Should you need any further help or assistance then please call the helpline number on the Terms & Conditions board at any of the Travelodge car parks.

 

 

7. Cancelling & Amending a Booking *

 

7.1 You are able to cancel your booking and receive a full refund providing you notify us of the cancellation 24 hours prior to the arrival date & arrival time specified on the Car Park Booking.  Customers can also do this themselves via the ‘Manage my parking booking’ link available at the top of each page. 

Cancellations made within 24 hours of the original arrival date and time on the car park booking will not be refunded unless authorised by Travelodge Hotels.

Amendments can be made up to the arrival time and date stated on your original car park booking. Once the arrival time and date of your original car park booking has passed you cannot amend a booking.

You can cancel or amend your Booking online at https://travelodgeparking.apcoa.co.uk by selecting Manage my parking booking on the top right hand side of the screen.

 

7.2 b)Cancellation or Amendment by telephone

You can cancel or amend your Booking by calling us on the following telephone number: 0344 332 1236.

 

7.2 c) Cancellation or Amendment by e-mail

You can cancel or amend your Booking by e-mail to travelodge@apcoa.co.uk.

 

* We recommend that you cancel or amend your Booking online or by telephone. You can write to us, although your cancellation will not take effect until we receive your letter. Proof of posting is not sufficient to cancel your booking. We recommend postal cancellations are followed by a telephone call to confirm your cancellation has been received.

 

7.3 You will be charged in full for your Booking if you leave the Car Park before the end of the Booking Period.

 

 

8. Prices and How to Pay

 

8.1 The price that you are quoted includes VAT and is fixed when you make your Booking.

 

8.2 You can pay for your Booking by using any of the credit or debit cards that we accept. Details are shown on the booking form you will complete when making your booking online at https://travelodgeparking.apcoa.co.uk. If booking by telephone, the telesales staff will present the payment card options to you. We may charge for the use of credit or debit cards, and the charge may vary according to which card you use. We do not accept payment by cash or cheque.

 

9. What to do on Arrival

 

We do not issue tickets for pre-paid Bookings. The arrival procedures will vary by car park.  In most cases you need to leave your booking form on the dashboard of your vehcile displaying clearly the booking period and Vehicle Registration Number (VRN), this should match the vehicle used by "you".  To be sure please refer to the details provided on your booking confirmation form.

 

 

10. Vehicles Permitted in our Car Parks

 

10.1 We only accept Bookings for cars and light vans. You are not entitled to a refund if your Vehicle exceeds the size limits we impose. Please contact us (contact details are set out in condition 13) if you would like to check whether your Vehicle will be accepted.

 

10.2 When you book you will be required to specify the registration number of the Vehicle to which the Booking relates. You may change these details at any time before you arrive at the Car Park, at no charge, by contacting us. Our contact details are set out below in condition 13.

 

 

11. Our Responsibility to You

 

11.1 Once you have booked and we have received payment for that Booking, you are entitled to park the designated Vehicle in your selected Car Park on the date(s) specified in your Booking. Parking of your Vehicle will be subject to the Conditions of Parking.

 

11.2 On very rare occasions, we may not be able to accommodate your Vehicle.  The prepayment via https://travelodgeparking.apcoa.co.uk for the booked period does not reserve or guarantee you a space, but does mean you do not have to worry about purchasing a pay & display ticket on arrival. If on the very rare occasion we cannot accommodate you, we will do our utmost to let you know as soon as possible. If we cannot accommodate you anywhere on site, then we will direct you to the nearest car park & a FULL refund will also be provided. This summarises the full extent of our liability to you.

 

11.3 We will only use your information for the purpose of processing your booking and payment. We will not disclose your information to anyone outside APCOA, except where we are required or permitted to do so by law.

 

 

12. Comments and Complaints

 

12.1 We request that all comments relating to the Booking procedure and experience are made in writing to us at the address set out in condition 13.

 

12.2 We aim to answer all complaints within 5 working days. If this is not possible, we will tell you when we expect to be able to respond.

Pay and Display Terms and Conditions of entry/parking

 

THESE ARE THE TERMS ON WHICH YOU AGREE TO USE OUR CAR PARKS. IT IS IMPORTANT THAT YOU READ THEM AND UNDERSTAND THEM. THEY EXPLAIN YOUR RIGHTS AND OBLIGATIONS. THEY ALSO CONTAIN DETAILS OF MATTERS FOR WHICH WE DO NOT ACCEPT RESPONSIBILITY.

 

1. Definitions

“Car Park” means the car park controlled by us at which these Conditions of Parking are displayed. It also includes, where the context allows, the approaches to and exit roads from the Car Park.

 

“Permit” means any agreement for the parking of a Vehicle.

 

“Permit Parking: Additional Conditions” means any terms and conditions subject to which a Permit is issued.

 

“Reserved Space” means any parking space containing a notice indicating that it is reserved for a specific person, firm or company.

 

“Reserved Parking: Additional Conditions” means any Terms and Conditions subject to which a Reserved Space is allocated.

 

“Tariff Board” means any board or notice at the Car Park displaying the charges to be paid for parking.

 

“Vehicle” means any vehicle which is parked in a Car Park and includes any mechanical device on wheels or tracks, its equipment and accessories.

 

“We, us, our” means Apcoa Parking (UK) Limited.

 

“Your, you” means any person who uses the Car Park for the parking of a Vehicle.

 

 

 

2. THE AGREEMENT BETWEEN YOU AND US

 

2.1 These Conditions apply to your use of the Car Park.

 

2.2 We follow & stand by these Terms and Conditions. If there is anything you do not understand or do not agree with, please discuss this with us before you enter the Car Park or leave your Vehicle with us.

 

2.3 Our employees or authorised agents are not permitted to make any representations unless these are confirmed in writing. If we agree changes, please ask us to confirm them in writing.

 

2.4 Nothing in these Conditions affects your statutory rights.

 

 

3. CHARGES

 

3.1 The sums we charge for parking in the Car Park will be displayed on the Tariff Board and can be altered at any time at our discretion. Any changes will not affect you if you have already taken a car parking ticket on entry to the Car Park.

 

3.2 In the event of any Pay Machine failure, you are responsible for finding a Pay Machine that works. We also reserve the right to collect the charges for parking at the exit of the Car Park as Vehicles leave.

 

 

4. TICKETS

 

4.1 The ticket issued is valid only for the Vehicle in respect of which it is issued. Your ticket does not entitle you to use any particular space in the Car Park or to have priority over other customers.

 

4.2 All tickets are our property.

 

4.3 If you are required to display your ticket in your Vehicle this will be clearly stated on your ticket and also on signs within the Car Park. Please ensure your ticket is displayed prominently. If the printed information on the ticket is obscured, or if the ticket cannot be seen clearly from outside the Vehicle, we will assume you do not hold a valid ticket to park in the Car Park.

 

4.4 Unless you are required to display your ticket in your Vehicle you must keep your ticket with you when you leave your Vehicle. If you lose your ticket you will be charged at the rate specified on the Tariff Board.

 

4.5 If you are permitted to pay by credit/debit charge card, the cards which we will accept will be exhibited on this notice board or on the Pay & Display Machine. We will debit against your card the tariff charge appropriate for your stay at the Car Park (or at the rate specified on the Tariff Board if you lose your ticket) in addition to any administration charge levied against us by the credit/debit/charge card company.

 

4.6 Payment by phone, Pre-booking and Pay & Display tickets are non-transferable.

 

4.7 Pre-booked customers may not be guaranteed a parking space. If there is no space upon arrival having prebooked your ticket you will be entitled to a full refund. Please see contact details set out in point 13 in the event of this happening.

 

4.8 All customers paying via the Pay & Display machines on site must enter the Registration number for the Vehicle they are parking at time of purchase. Failure to do so may result in the issuing of a Parking Charge Notice.

 

4.9 All customers paying via the APCOA Connect payment by phone service must complete their payment transaction within a maximum of 15 minutes from the time of parking their Vehicle. Failure to do so may result in the issuing of a Parking Charge Notice.

 

 

 

5. MANAGEMENT AND ENFORCEMENT

…have responsibility for management of the roads and car parks on our behalf. Apcoa also have responsibility for enforcement of these conditions.

 

6. LIABILITY TO YOU FOR LOSS OR DAMAGE TO THE PROPERTY

 

Neither we or our servants or agents accept liability in respect of any damage to, loss or theft of or from your vehicle while on our property.

 

7. LIABILITY FOR DEATH OR PERSONAL INJURY

 

Nothing in these Conditions shall be deemed to exclude or limit our liability or the liability of our servants and agents for death or personal injury caused by negligence.

 

 

8. WHAT TO DO IF YOU THINK YOU HAVE A CLAIM AGAINST US

 

If your Vehicle is damaged whilst on our property or is stolen or any of your possessions are stolen from it whilst it is on our property you must:-

- Immediately inform a member of Travelodge staff if one is available;

- Notify Apcoa using the contact details set out in condition 5; and

- Notify the police & your insurers promptly.

 

9. WHAT TO DO IF YOU HAVE A COMPLAINT

 

We operate a complaint handling procedure, details of which are available through Apcoa. To enable complaints to be dealt with efficiently it is important that complaints are made as soon as reasonably possible. All complaints should be received by 14 days from the expiry of your parking session. You understand that if you do not adhere to any time limited we may not be able to do anything about your compliant.

 

10. WHAT HAPPENS IF YOU BREACH THESE CONDITIONS

 

If you park your Vehicle in breach of these Conditions we will attach a Parking Charge Notice (PCN) to your Vehicle or hand a PCN to you. The PCN will specify:-

- The sum you are required to pay;

- The time within which payment must be made; and

- The address to which payment must be sent.

The PCN will also explain that unless payment is made in accordance with its terms court action may be commenced to recover the sums due from you under the PCN together with costs, interest and any other sums legally recoverable.

 

 

11. MOVING AND RE-LOCATION OF VEHICLES

 

11.1 We reserve the right to move your Vehicle by driving or otherwise to such extent as we think in our discretion where this is necessary to avoid obstruction or for the more efficient arrangement of parking facilities on our property.

 

11.2 In addition, we reserve the right where the Car Park has to be closed either permanently or temporarily in whole or in part, or has to be evacuated in cases of emergency or otherwise to remove your Vehicle at any time to any other location as we reasonably deem appropriate.

 

11.3 To the extent that it may be necessary to do so in the exercise of the rights given to us in these Conditions, we, our employees, servants or agents have the right to drive or otherwise take any Vehicle out of the Car Park or tow it away.

 

11.4 We reserve the right to enter a Vehicle (and to use force if necessary) in such a manner as we think necessary without being liable for damage caused to facilitate the exercise of the rights given to us in these Conditions or to abate any nuisance caused by your Vehicle.

 

12. DAMAGE TO OTHER VEHICLES OR PROPERTY ON OUR PROPERTY

 

Should you damage another Vehicle or our property, or cause damage to the Car Park you must report the matter immediately to a member of Travelodge staff and Apcoa in the contact details set out in condition 5.

You should give Apcoa & the Travelodge member of staff the registration number of your Vehicle and any other Vehicle involved as well as your full name and address and the name and address of your insurance company together with your policy number.  You will be required to make good to our reasonable satisfaction any damage caused, or to pay to us on demand the cost incurred by us in making good such damage.

 

13. PERMIT PARKING

 

13.1 If you have a Permit, this will allow you to access the Car Park at the times specified on the Permit.  You must not park your Vehicle outside the stipulated hours unless you pay the relevant tariff payment.

 

13.2     During permitted periods your entry to the car park will be subject to any Permit Parking: Additional Conditions.

 

13.3     Where there is any inconsistency between any Permit Parking: Additional Conditions and these Conditions, the Permit Parking: Additional Conditions will prevail.

 

14. RESERVED PARKING

 

14.1 If you have a Reserved Space, your use of the Reserved Space will be subject to any Reserved Parking: Additional Conditions.

 

14.2 Where there is any inconsistency between any Reserved Parking: Additional Conditions and these Conditions, the Reserved Parking: Additional Conditions will prevail.

 

15. SAFETY AND SECURITY

 

15.1 You must drive carefully and strictly observe any speed limits.

 

15.2 You must beware of Vehicles in motion.

 

15.3 You must comply with all directions and signs from time to time posted in the Car Park and all instructions or requests given or made from time to time by our employees, servants or agents (including Apcoa) for regulating traffic and controlling the positioning of Vehicles in the Car Park.

 

15.4 You must ensure that animals are kept secured on a lead when outside a Vehicle.

 

15.5 You should ensure:

a) Your Vehicle is securely locked.

b) All the windows of your Vehicle are securely locked.

c) Your brakes are applied as appropriate for the parking mode.

d) If your Vehicle is fitted with a steering lock or similar device that it is engaged.

e) No person or animal is left in your Vehicle; and your possessions are placed in your locked boot and are not visible from the exterior of this Vehicle.

 

16. PROHIBITED ACTIVITIES

 

16.1 You should not:

a) Park in a no parking area.

b) Park on a double yellow line.

c) Park other than in a designated parking bay.

d) Park in a time restricted waiting area for a period in excess of the allowed time.

e) Park in a disabled bay without displaying the required current valid badge.

f) Park across two parking bays.

g) Park in an area reserved for emergency Vehicles.

 

These restrictions also apply to disabled badge holders.

 

16.2 No vehicle shall be towed into the Car Park or enter otherwise than under its own mechanical power and no work or repairs or maintenance to or washing of or cleaning of Vehicles shall be done in the Car Park.

 

16.3 No activity in connection with the selling, hiring or other disposal of the Vehicle shall be carried out in the Car Park.

 

16.4 No Vehicle shall obstruct any access or circulation area within the Car Park. 

 

16.5 No person shall do anything that may be a nuisance or inconvenience to us, or employees, servants or agents (including Apcoa) or to any other users of the Car Park.

 

16.6 No Vehicle shall cause any unnecessary noise, vibration or exhaust fumes.

 

16.7 No person shall deposit any rubbish, litter or refuse of any kind in the car park property other than in proper receptacles provided for the purpose.

 

16.8 No person shall pour or transfer petrol or other fuels into or out of the fuel tank of any Vehicle.

 

17. VEHICLE SIZE

 

You are required to observe all reasonable restrictions as shall from time to time be made by us or its servants or agents in respect of the height, length or width of Vehicles to be allowed access to the car park.

 

18. Automatic Number Plate Recognition (ANPR)

 

Automatic Number Plate Recognition may be used on all entry and exits from the car park and will be used to monitor vehicle movements. Timed photographs are taken of Vehicles entering and leaving the car park, including high resolution images of the Vehicle registration mark which will be used to access the DVLA’s vehicle keeper database. If a driver contravenes any of the Terms and Conditions laid out herein and in the signage on site, where ANPR cameras are in use, a postal Parking Charge Notice may be issued to the registered keeper of the Vehicle in question.
